List of countries that have enacted the Model Law (External Website)
The cases included on these pages interpret national legislation enacting the UNCITRAL Model Law on Cross-Border Insolvency. The cases included come from as many of the 20 enacting States as possible (not all countries enacting the Model Law have had such cases arise). From jurisdictions with a large number of cases, such as the USA, the focus is on the key cases that contribute to interpretation of the Model Law.
Interpretation of the Model Law is discussed in The UNCITRAL Model Law on Cross-Border Insolvency: the Judicial Perspective, which includes summaries of the key cases discussed. Information on cooperation in cross-border insolvency cases is contained in the UNCITRAL Practice Guide on Cross-Border Insolvency Cooperation, These texts are available at: http://www.uncitral.org/uncitral/uncitral_texts/insolvency.html
More information on cases interpreting and applying the Model Law can be found on the UNCITRAL website under the Case Law on UNCITRAL texts system (CLOUT), which publishes abstracts of relevant decisions. The abstracts can be searched at: http://www.uncitral.org/clout/showSearchDocument.do
All UNCITRAL texts and abstracts are available in the 6 UN languages (Arabic, English, Chinese, French, Russian and Spanish).
