New Technical Paper - “Luxembourg Holding Companies: Embracing and Unveiling the Multifaceted Intricacies of COMI, Central Administration and Real Centre of Management”


Our 31st Technical Paper under the Technical Papers Series titled “Luxembourg Holding Companies: Embracing and Unveiling the Multifaceted Intricacies of COMI, Central Administration and Real Centre of Management” by Christel Dumont, Senior Counsel, Bonn Steichen & Partners. The paper examines the similarities and differences in the criteria for determining the Centre of Main Interest (COMI) or where the real central management is based. Ian Strang Founders Award Winner 2015

The Ian Strang Founders’ Award provides an educational opportunity for a postgraduate specialising in insolvency and turnaround to attend the Annual INSOL International Academics Colloquium or the annual INSOL International Conference. The ISFA will be awarded to the best paper put forward by a postgraduate covering this specific field of study. Announcing the 2015 Richard Turton Award Winner

The Richard Turton Award Panel is delighted to announce that the winner of the Richard Turton Award for 2015 is Waiswa Abudu Sallam from Uganda. Waiswa works for the Uganda Revenue Authority in the Debt Collection Department. He is currently studying for a Master of Laws in Corporate and Insolvency Law at Nottingham Trent University, UK (by distance learning).

New INSOL Special Report: When ‘Where’ Matters: Anchoring Jurisdiction in Insolvency

INSOL International is very pleased to present a Special Report titled “When ‘Where’ Matters: Anchoring Jurisdiction in Insolvency” by Jason D. Karas, Madeleine G. Harland and Scott B. Foreman of Lipman Karas - Hong Kong, Australia and London.

In many jurisdictions the case law on the extent to which claims involving an insolvent company should be permitted to be resolved through the arbitral process, or whether such claims should be allowed pursuant to other pre-insolvency contractual arrangements is still developing. Important public policy questions as to the role of insolvency law are also being debated because there is tension between the policy in favour of arbitration including enforcement of other forum selection agreements, and the policies which underlie the collective insolvency process.

This paper examines the judicial approach to these conflicting legal policies and details the trends that have emerged from the decided cases in different jurisdictions. It also examines the common law and civil code jurisprudence as to the extent to which claims involving an insolvent company may be resolved through the arbitral process or pursuant to other pre-insolvency contractual arrangements.

Release of INSOL Electronic Newsletter - Issue 04

The April edition of INSOL’s Electronic Newsletter has arrived after INSOL’s Annual Regional Conference held in San Francisco between March 22 and 24. As ever it is full of the latest global insolvency, restructuring and turnaround news and information from the past month and is another great showcase for the importance of INSOL and highlights the constant drive by the market to both push the boundaries of cross-border co-operation and also to encourage governments to improve and enhance local insolvency legislation.

INSOL International Launches the College of Mediation

As part of its constant development of services, INSOL International is establishing the INSOL College of Mediation (IICM) to deal with matters arising out of insolvency proceedings and restructuring or involving insolvency law, regulation or practice where mediation offers a more satisfactory method of resolving issues for the parties than litigation.

The College will be expanded to include an arbitration panel as well as mediation in the future.

Ian Strang Founders Award 2014

The Ian Strang Founders Award panel is delighted to announce that the winner for 2014 is Jennifer L. L. Gant. Jennifer is a PhD in Comparative Employment and Insolvency Law at Nottingham Trent University where she currently works as a Research Assistant.

As part of the award Jennifer is invited to attend INSOL San Francisco which will take place on 22-24 March 2015 or the Academics Colloquium. The paper she has written is titled "Studies in Convergence? Post-Crisis Effects on Corporate Rescue and the Influence of Social Policy: The EU and the USA" and will be published in future.

We would like to congratulate Jennifer for her excellent application and also thank all the candidates who applied for the award this year. There were many excellent submissions and the judges task was particularly difficult.
