Mr. Mathew Clingerman
Mathew Clingerman is a Senior Manager at Krys & Associates Cayman Ltd. with experience on a number of complex cross-border insolvency cases. These engagements have included the court supervised liquidations of the SPhinX group of companies, a large and complex group of hedge funds, PFA Assurance Group, Ltd., Citrico International Limited, and Dyoll Insurance Company Limited. Some of the international aspects of Mathew's assignments have included: - supporting an application to a U.S. Bankruptcy Court, made by the Liquidators of the SPhinX companies, for recognition of the Cayman Islands insolvency proceedings in the United States under Chapter 15 of the U.S. Bankruptcy Code; - leading the financial development of a proposed group of inter-dependant schemes of arrangements and bi-lateral agreements to distribute liquidation estate assets to investors/creditors and considering the legal implications of the proposed scheme structures; - Overseeing efforts to negotiate an international protocol agreement between Cayman Islands Liquidators and a U.S. court appointed Receiver dealing with various aspects of their cooperation; - Managing the realization and collection of assets including third party litigation actions and strategy in the Cayman Islands, United States and other jurisdictions; Prior to joining Krys & Associates Mathew was employed by RSM's corporate recovery group in the Cayman Islands. His previous experience also includes managing attest engagements for broker-dealers, futures-commissions-merchants, investment managers, and hedge funds for McGladrey & Pullen, LLP and its affiliates in Chicago, Illinois and Dublin, Ireland. Mathew graduated cum laude from Valparaiso University with a Bachelor of Science in Accounting. He is a Chartered Financial Analyst charterholder, a Certified Fraud Examiner and has passed the uniform Certified Public Accountant examination in the United States.
