This hybrid seminar, co-hosted by INSOL Asia Hub and Mayer Brown, explored the future of rescue financing in Singapore and the rescue financing tools available across jurisdictions and how they are deployed in distressed financing and restructuring scenarios. The discussion considered Singapore’s relatively new rescue financing regime, and the role rescue financing can play in commercial transactions.

Attendees gained a better understanding of the tools available in distressed financings and restructuring scenarios, the opportunities in which such tools may be successfully deployed, and how rescue financings are conducted in different jurisdictions.

Distressed Airlines Series: The Modern Toolkit for Asia and Beyond

This online webinar explored issues arising in the restructuring of airlines in Asia. Our experts shared their experiences on the restructuring of three Asian airlines: (1) Thai Airways, (2) NOK Air, and (3) Hong Kong Airlines, and the restructuring of LATAM Airlines, based in Chile. This diversity of restructuring cases enabled participants to take a comparative view towards airline restructuring which, in some jurisdictions, might be influenced by domestic policy considerations.

Additionally, our experts discussed legal and non-legal issues which may arise in an airline restructuring exercise. The former comprises issues such as the Cape Town Convention and the Gibbs Rule, and the latter consists of issues such as the management of crucial stakeholders, as well as conducting refinancing exercises for the financially distressed airline.

Distressed Airlines Series: Reflecting for the Future

The Seminar explores issues arising in the restructuring of airlines in Asia. Our experts will discuss general issues like the difference between (a) a successful and unsuccessful airline restructuring, and (b) opting for local and foreign proceedings. More specific legal and non-legal issues will also be discussed. The former comprises issues such as the Cape Town Convention and the Gibbs rule. The latter comprises issues such as interactions between stakeholders, and financing in the region.

Participants will learn what goes into a successful airline restructuring in Asia, and the factors that an airline would have to consider before deciding between a local and foreign proceeding. They will also learn of the legal developments and complications in this area, specifically involving the Cape Town Convention and the Gibbs rule. Lastly, they will gain a better understanding of the state of financing, and the interactions between stakeholders specific to airline restructuring in Asia.
