As part of Singapore Convention Week 2025, INSOL Asia Hub and Rajah & Tann Asia will be co-hosting a seminar on recent developments on the legal and practical tension between arbitration agreements and insolvency. This discussion will analyse recent judicial decisions such as the UK Privy Council’s decision in Sian Participation Corp (In Liquidation) v Halimeda International Ltd [2024] UKPC 16 to understand how Courts are navigating tensions between insolvency’s collective processes and contractual autonomy to determine the effect of arbitration agreements in insolvency.
Panellists will discuss issues of enforceability, jurisdiction, and public policy, alongside practical implications for creditors and debtors navigating arbitration and insolvency. Attendees will also benefit from an evaluation of current and potential initiatives that may shape and clarify the use of arbitration in insolvency.
