About INSOLAD
Founded in 1991 as a specialist association within the Dutch Bar Association, INSOLAD has grown to represent over 700 members, including prospective members and fellows. Our primary objective is to be a pivotal force in advancing the Dutch insolvency practice, ensuring it meets the highest local and international standards of quality and professionalism.
INSOLAD is dedicated to fostering expertise in insolvency law among its members, who are experienced lawyers engaged in various roles such as:
• Acting as trustees in bankruptcies;
• Serving as administrators in suspension of payments;
• Acting as restructuring experts or observers under the Dutch Scheme legislation;
• Assisting companies or individuals in financial distress;
• Conducting legal proceedings on insolvency matters; and
• Providing expert advisory services
Prospective members, who are in the process of gaining requisite experience or passing the entrance exam, are welcomed, provided they focus a significant portion of their practice on insolvency law.
Continuous Professional Development and Knowledge Sharing
INSOLAD is committed to the continuous professional development of its members. We organise a comprehensive programme of training courses and workshops, addressing both current developments and fundamental themes in insolvency law. This ensures our members maintain and deepen their expertise, aligning with the highest standards of practice. Each member is obliged to follow the post-academic and insolvency course Grotius INSOLAD.
To further enhance the quality of trusteeship, INSOLAD has established the INSOLAD Rules of Practice for Trustees, which serve as a benchmark for professional conduct. We also encourage informal interactions among members to facilitate the exchange of information and effective collaboration in cases.
Dutch Scheme (WHOA)
INSOLAD plays a crucial role as a specialist observer and restructuring expert under the Dutch Scheme or WHOA. This involvement underscores our commitment to guiding and shaping restructuring practices within the Dutch legal framework, ensuring that our members are at the forefront of developments in this area.
Advocacy and International Engagement
INSOLAD actively represents its members' interests by engaging with key stakeholders in the insolvency practice, including legislators, the judiciary, financial institutions, and tax authorities. We maintain robust connections with European and international associations, exchanging best practices and experiences to elevate the quality of insolvency practice globally.
Our membership is open to those with a vested interest in insolvency law, reflecting a diverse range of backgrounds, including lawyers, judges, financial advisors, and academics. By fostering a community that spans both national and international spheres, INSOLAD serves as a vital resource for professionals seeking to enhance their understanding and practice of restructuring insolvency law.
